To provide an adequate defence in the event of harm resulting from tree failure, it is usually necessary to demonstrate that you have not been negligent and have acted reasonably in the management of your trees and that you have thus discharged your duty of care.

Tree managers should seek a balance and manage tree failure risk at an appropriate level and optimise the benefits from trees whilst maintaining reasonable safety.
